The CDC eviction moratorium has been in effect for nearly 2 months. It prevented landlord's from evicting tenants for non-payment of rent if the tenant signed a certain declaration under penalty of perjury.
Landlords have expressed frustration because they believe that some tenants may be completing the declaration dishonestly. The old procedure also prevented evictions from proceeding at all once a declaration had been signed.
Attorney Adam Williams, solicitor for the Apartment Association of Northwestern Pennsylvania, coordinated with President Judge John Trucilla in the creation of a procedure for landlords to challenge CDC declarations filed by clients. It also allows eviction hearings to proceed, even if the declaration has been filed (under certain circumstances).
